Valid I don't like it, but it seems as though the 6th Circuit is correct in its findings. They didn't know any better, and whether that's right or wrong, it dictated that what they did in this case prosecution was legal and kosher. I've written about this very issue, as I'm a legal newspaper reporter. Here in Indiana and at the national level, officers are losing more of these types of cases because of their lack of training - so there's that. It just doesn't fit the facts of what happened here and that's not the key issue in this case.
