Default Way OT-But Need Answers/Advice

What would happen if someone in your house was selling/doing drugs and got caught? Would everyone in the house be in trouble or just the person/people actually doing it?

I suppose there are many different circumstances, but I believe that they will take the kids away if there are any kids involved.

I know of a case where the mom was using meth and repeatedly failed the court mandated drug tests. Not exactly sure of the charges or how it went down, but the dad told us that the court mandated they get divorced if he wanted to keep the kids---they then granted him sole physical custody and mom had supervised visitation.

I have zero tolerance for drugs, DUI, etc

It depends on alot of different things but I am pretty sure most places yes eveyone could end up in jail.

I know your situation is similar to that of my sister's for a couple of years. We would all debate about it, but the situation eventually resolved itself. There were OTHER children in the house that we all didn't think were being properly cared for. The general consensus was that they really didn't deserve the parents they had, but the parents would not change. Kids unsupervised, not bathed regularly (by parents), and an unbelievable sleep schedule for the whole group of them.

The problem was that there was ANOTHER child in the house that was impecably cared for, but if we broke down and called CPS for the others, ALL the children would probably be removed, and all adults would probably be held responsible for not taking better care of the uncared for children. It was a real catch-22. Basically, the care just fell on everyone else in the family, with concerns of what would happen if/when they moved out with no one to help. There was also a REAL suspicion of drugs.

Unfortunately, I think that initially all children would be removed until an investigation could be done, but I can't really see every adult being arrested. I could be wrong though.

I think it really depends. Here in MA, if you're receiving public assistance or living in public housing and anyone in your home is caught selling drugs then you are ALL removed from assistance. The law is designed this way so that people do not give a refuge to drug dealers (sons/daughters/cousin etc) moving in with their grandmother/mother/aunt

In Alabama if one parent was using/dealing, then that one would go to jail for using/dealing and the other would go to jail for abetting, and the children would be taken away. It takes years for the parents to see their children again once they are taken.

It probably depends on the class of drug and your state laws. Look them up.

Be aware that you have a lot of personal info floating around online, and your whole family's picture posted.

ETA: And if this indeed is not hypothetical, and applies to your living situation, you've just admitted to knowing about the alleged drug use/selling.

Um, assuming this is not a hypothetical, I guess my answer to you is, "Does it really matter?!"

I would not have my kids around someone using/doing drugs, period. Even if you're not worried about that person, the people they are associating with are criminals, and do not care if your family or kids get hurt.

It does vary from state to state, and also how much of the drug is actually there. But if they were busted in the home, and they saw minor children, CPS would be called.
